O R D E R

% 16.10.2017 The learned counsel for the respondent states that the powers of the Chief Settlement Commissioner are to be exercised by the Additional Secretary or the Special Secretary, (Land & Building), Government of NCT of Delhi and, therefore, the petitioner's appeal can be heard. He points out that the present petition had been entertained only on the assertion that no person had been appointed as a Chief Settlement Commissioner.

In view of the above, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to pursue the appeal before the Chief Settlement Commissioner. She further requests that the interim order

passed on 29.05.2015, be continued for a further period of four weeks. The petition is dismissed as withdrawn with liberty to the petitioner to pursue his appeal before the Chief Settlement Commissioner, Evacuee property.

The interim order passed on 29.05.2015 shall continue for a further period of four weeks from today. The concerned Chief Settlement Commissioner shall take up the petitioner's appeal within the aforesaid period and pass such orders as he thinks fit (including interim orders). In the first instance, the petitioner will appear before the Chief Settlement Commissioner on 24.10.2017 at 3:00 PM. Order dasti under signatures of the Court Master.
