W.P.(CRL) 3173/2016 Issue notice. Notice is accepted on behalf of the State. Counsel for respondent no.2 also accepts notice. He states that he shall be filing his vakalatnama during the course of the day. He identifies respondent no.2. Respondent no.2 is identified by the I.O. as well. The petitioners have filed the present petition seeking quashing of FIR No.562/2013 registered on the complaint of the complainant under Sections
498A/ 406/ 34 IPC against the petitioners at Police Station PS Jamia Nagar. The parties have arrived at a settlement on 17.03.2016, which has been placed on record. The divorce deed dated 29.04.2016 has also been placed on record. Under the settlement, out of the total settlement amount of Rs. 2 lakhs the complainant has already received an amount of Rs.1.50 lakhs. The balance amount of Rs.50,000/- has been tendered to her in Court today by way of pay order bearing no.971098 drawn on Bank of India. The complainant states that she has not been subjected to any pressure or coercion and that she has entered the settlement out of her own free will. The complainant further states that she joins the prayer for quashing of the FIR in question.
Accordingly, no useful purpose would be served in proceeding further with the FIR in question and the proceedings emanating therefrom. The same are hereby quashed.
