% 22.08.2017 Learned counsel for the petitioner has contended that the petitioner had simply witnessed the agreement to sell and other documents. She is not the owner of the subject properties, in as much as, she is not even the Director of the company from which the complainant has allegedly purchased the subject properties. It is further contended that the petitioner has cooperated in the investigation and she may be granted anticipatory bail. Learned APP, who is assisted by the learned counsel for the complainant, has vehemently opposed the grant of anticipatory bail to petitioner. She contends that complainant had purchased first floor and ground floor of property no.G-10, Kirti Nagar, New Delhi for a
sum of `80 lacs and `70 lacs respectively from M/s. Rajasavi Estates & Developers Pvt. Ltd. through separate Sale Agreements duly executed by Savita Bhatia and Abhishek Bhatia in favour of the complainant and 90% of the sale consideration was paid to them, inasmuch as, possession of both the floors was handed over to complainant on 15th January, 2010.
However, sale deeds were not executed by the accused despite negotiations.
Subsequently, complainant learnt that accused had sold the property to some other persons. It is submitted that Ms. Savita Bhatia and Abhishek Bhatia are mother and brother of petitioner. Learned APP has not disputed that petitioner has signed the documents only as a witness. Keeping in mind totality of the circumstances, it is ordered that in case of arrest, petitioner be released on bail, subject to her furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO concerned.
Bail application is disposed of in the above terms. Dasti.
