% 09.11.2016 Respondent nos. 3 to 8 are relatives of the petitioner. Marital discord between the petitioner and respondent no. 2 had led to registration of the present FIR No. 144/2016 under Sections 498-A/406/34 IPC and Section 4 of the Dowry Prohibition Act, 1961 at P.S. Seelampur on the complaint of respondent no. 2 against the petitioner and his family members, that is, respondent nos. 3 to 8.
With the intervention of elders in the family, Petitioner and respondent no. 2 have resolved their differences and have
started living together. Respondent no. 2 is present in Court and has been identified by SI ASI Datta Ram, P.S. Seelampur, submits that she has settled the matter with the petitioner on her own free will and without any undue force, coercion and pressure. She further submits that she is living with the petitioner in the matrimonial home for about a month. She further submits that FIR be quashed.
Keeping in mind that husband and wife have resolved their differences and have started living together, no fruitful purpose would be served in keeping them entangled in the criminal proceedings. Accordingly, in the interest of justice, FIR No. 144/2016 under Sections 498-A/406/34 IPC and Section 4 of the Dowry Prohibition Act, 1961 registered at P.S. Seelampur, which is at the investigation stage, is quashed. Petition is disposed of in the above terms.
