Crl. M.A. 2379/2019 (by R-4 for recall of order dated 17.09.2018) Issue notice. The learned counsel, named above, accept notice. At request the application is taken up for disposal. The applicant seeks modification of the order dated 17.09.2018. It is his apprehension that the order may be construed as a direction to the respondents to initiate statutory proceedings against the applicant.
The Court is unable to discern any such direction. The order merely directs the respondents to look into the petitioner's complaint and the respondents' action, as may be, was to be communicated to the petitioner within eight weeks of the said order.
The Court is informed that some communication has been made to the petitioner. However, the applicant apprehends that the actions are likely to result in an unwarranted prosecution against him, especially, when according to him, all aspects of the petitioner's complaint have already been adjudicated upon or the matter has, otherwise, been disposed off. In the circumstances, this application shall be considered as the applicant's representation by the Directorate of Enforcement and the other respondents. After due consideration, the decision(s) shall be communicated to the parties.
