O R D E R

% 21.04.2017 By the present petition the petitioner seeks anticipatory bail in case FIR No.562/2016 under Section 420/506 IPC registered at PS Sangam Vihar.

Learned APP on instructions submits that besides the complainant no other victim is involved in the above-noted FIR. The allegations against the petitioner in the complaint lodged by Anishul Rehman are that one Sohaib introduced Anishul Rehman to the petitioner informing him that the petitioner can provide him a job in the Railways. The petitioner took an amount of ₹3,61,000/- from the complainant to provide him a job in the Railways, however despite taking the money the complainant neither got the job nor the money was returned BAIL APPLN. 2166/2016

to him. During the course of investigation it was revealed that ₹58,000/- had been deposited in the account of the complainant. In respect of the balance amount to show his bonafides, the petitioner has deposited a sum of ₹3,03,000/- before the learned Trial Court without prejudice to his rights and contentions.

Considering the fact that the petitioner has already joined the investigation and has deposited a sum of ₹ 3,03,000/- before the Trial Court without prejudice to his rights and contentions, this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned. In case of change of address, the same will be intimated to the learned Trial Court by way of an affidavit.

Petition is disposed of. Order dasti.
