O R D E R

% 20.04.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner seeking grant of anticipatory bail in case FIR No.584/2016, under Section 12 of POCSO Act, 2012, registered at Police Station Safdarjung Enclave, Delhi.

Counsel for the petitioner submits that the petitioner is a law abiding citizen and the allegations alleged in the FIR are false. He submits that nothing is to be recovered at the instance of the present petitioner. He further submits that the petitioner is ready to join further investigation as and when directed to do so and prays that the petitioner be granted anticipatory bail. Learned APP for the State vehemently opposes the grant of anticipatory bail to the petitioner and submits that the petitioner has joined investigation but there are subsequent complaints on behalf of the complainant that the petitioner is still using filthy language and gestures.

Keeping in view the facts and circumstances of the case, the petitioner is directed to join the investigation as and when directed to do so and in the event of his arrest, the petitioner shall be released on anticipatory bail on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned with the condition that the petitioner should not visit the house of the prosecutrix and shall not try to contact the prosecutrix or her family members in any manner whatsoever; the petitioner shall not tamper the prosecution evidence and he should not leave India without prior permission of the Court below.

The present petition is disposed of accordingly. Copy of this order be given dasti, as prayed. I.S.MEHTA, J APRIL 20, 2017/radhika
