Ms. Rao, the learned Additional Standing Counsel accepts notice for State.
At joint request, the petition is taken up for disposal. This writ petition seeks release of the petitioner on parole for a period of three months to search a suitable life partner for himself as well as to reestablish social and family ties. His address has been verified by the Police. A perusal of the petitioner's Nominal Roll dated 31.08.2018 reveals that his conduct in jail has been satisfactory since the inception of his incarceration; he has already undergone incarceration for 5 years 4 months and 8 and has earned a remission of 1 year and 6 days out of the total sentence of ten years of rigorous imprisonment. Furthermore, the petitioner had earlier been released on furlough twice i.e. from 27.02.2018 to
20.03.2018 and from 01.06.2018 to 15.06.2018 and has not misused the liberty granted to him.
In view of the foregoing, the Court finds no impediment in allowing the present petition. Accordingly, the petitioner is granted parole for a period of one month from the date of his release on his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent concerned, subject to the following conditions:-
(1) The petitioner shall report to the Station House Officer, concerned Police Station Parliament Street, New Delhi, once a week on every Tuesday during the period of parole;
(2) He shall furnish his telephone number to the SHO concerned, which the petitioner shall keep operational at all times. (3) The petitioner shall surrender before the Jail Authorities at the expiry of the period of parole.
With the above directions, the writ petition stands disposed-off. A copy of this order be given dasti to the learned counsel for the parties and a copy be sent to the Jail Superintendent concerned for compliance.
