% 21.02.2019 Learned counsel for the petitioner submits that subsequent to the passing of the impugned order there are some judgments of the Supreme Court settling certain legal propositions which were not urged by him at the time of consideration of his earlier bail application. He seeks leave to withdraw the petition with liberty to file a fresh petition for bail before the Trial Court.
In view of the above, petition is dismissed as withdrawn with the liberty to the petitioner as prayed for.
Learned counsel for the petitioner submits that interim bail granted to the petitioner by order dated 12.12.2018 and extended on 06.02.2019 is expiring on 06.03.2019. He submits that he shall also be approaching the trial court for grant/extension of interim bail. It would be open to the Trial Court to consider the application of the petitioner for grant/extension of interim bail on its merit. Order dasti under signatures of the Court Master.
