1. Learned counsel for the parties agree that in terms of the arbitration clause, Justice V.S. Agarwal, a former Judge of this Court is to be the Arbitrator in the event of the first named Arbitrator in the arbitration clause in the agreement not being able to continue as such.
2. In that view of the matter, the parties are directed to write to Justice VS Agarwal within one week from today requesting him to take over from where the proceedings are at present. The parties will arrange to have the records collected from the earlier Arbitrator and make them available to Justice Agarwal without unnecessary delay.
3. The petition is disposed of in the above terms. Order be given dasti to learned counsel for the parties.
