O R D E R

% 19.11.2018 By this petition the petitioner claim that she was a major and left her parents house on 13th August, 2013 when the respondent No.3 and respondent No.6 who are her father and parental uncle respectively were pressurizing her to marry respondent No.4 which marriage petitioner did not wish to solemnise for the reason respondent No.4 is into alcohol addiction. She prefer to stay separately in Delhi.

A status report was filed verifying the age of the petitioner and as per the status report the date of birth of petitioner is 15th August, 2003 and hence presently she is a minor. Petitioner is present in Court and states that she is now willing to go with the parents, since the parents have already filed an W.P.(CRL) 2747/2018

affidavit in Court that they will not marry the petitioner before she attains the majority.

In view of the fact that affidavits have been filed by both the parents of the petitioner stating that they will not be performing marriage of the petitioner before 18 and they also state that the marriage will be of the choice of the petitioner, no further orders are required to be passed except stating that custody of the petitioner be handed-over to her parents who are present in Court and they will abide by their undertaking. Petition is accordingly disposed of.

Copy of the order be given dasti under signature of Court Master to learned counsel for the State for onward transmission to the Superintendent, Nirmal Chaya.
