W.P.(C) 9844/2016 Learned counsel for the respondent, who appears on advance notice, submits that on 21.10.2016, the respondents have passed an order declining the request of the petitioner to extend the Contract. He submits that the present petition has become infructuous.

Learned counsel for the petitioner submits that no such order has been communicated to the petitioner. Copy of the order has been handed over to the counsel for the petitioner in Court. Copy of the order has been produced in Court and the same is taken on record.

Learned counsel for the petitioner prays for leave to withdraw the WP(C) 9844/2016

petition with liberty to file appropriate proceedings impugning the order dated 21.10.2016 and also impugning the fresh tender proposed by the respondent.
