CRL.M.C. 4093/2016 & Crl.M.A. 17093/2016 By the present petition the petitioner seeks quashing of FIR No.501/2015 under Section 135 of the Electricity Act registered at PS R.K. Puram on the complaint of respondent No.2 alleging theft of electricity on the ground that the parties have settled the matter. Learned counsel for the respondent No.2 is present along with senior Legal Manager Ms. Jaya Thakuria who is authorized to make statement on behalf of the respondent No.2.

Ms. Jaya Thakuria states that the respondent No.2 has settled the matter with the petitioner and as against the civil liability amount of ₹1,38,774/- the respondent No.2 has agreed to a settlement for a sum of ₹40,865/- which have already been received by the respondent No.2. Thus the respondent No.2 does not wish to pursue the above-noted FIR and the proceedings pursuant thereto.
Since the parties have settled the matter and no useful purpose would be served in continuation of the above-noted trial and there is no legal impediment in quashing of the FIR, FIR No.501/2015 under Section 135 of the Electricity Act registered at PS R.K. Puram and the proceedings pursuant thereto are hereby quashed.
The petitioner and the senior legal manager of respondent No.2 Ms. Jaya Thakuria duly identified by the learned counsels have signed the order sheet in acknowledgement of their statements made before this Court The petition and application are disposed of. Order dasti. MUKTA GUPTA, J.
