CONT.APP.(C) 8/2016 & CM No.43741/2016(Delay) 1.

Apart from the fact that we see no cause to condone the delay of 113 days in filing of the appeal, we find no error in the impugned order for the reason that learned Single Judge has correctly held that order dated August 31, 2015 passed in WP(C) No.11487/2009 has been complied with. 2.

Tentative note of disagreement with respect to the report of the enquiry officer, calling upon the petitioner to make a representation thereto has been supplied. As regards the part of order of August 31, 2015 directing reinstatement with back wages, reinstatement has been effected with back wages.

If appellant has any grievance on the quantification of the back wages, he has substantial remedies as per law. As per the impugned order May 13, 2016 the learned Single Judge has granted liberty to the appellant to avail the remedies as available as per law. 4.
