% 13.06.2017 Crl.M.A.No. 9950/2017 (Exemption)
1. Allowed, subject to all just exceptions.
Bail Appln.No. 1137/2017
2. This is an application seeking anticipatory bail in FIR No.148/2017 under Sections 376/354 (C)/506 IPC, P.S. Moti Nagar.
3. The Court has also perused the order dated 12th May, 2017 by which the learned ASJ-01 has rejected the anticipatory bail application of the Petitioner. The submissions of learned counsel for the Petitioner have been heard.

4. The prosecutrix made a statement under Section 164 Cr PC which is yet to be tested in trial. In the meanwhile, the Petitioner appears to have been able to produce an affidavit of the prosecutrix which purportedly seeks to contradict her earlier statement. At best, this raises further questions which will have to be tested in the trial. Given the seriousness of the allegations, no case is made out at this stage for grant of anticipatory bail.
5. The petition is dismissed.
