HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 07.11.2016 CM No.41086/2016(exemption) Allowed, subject to all just exceptions.

W.P.(C) 10473/2016 The petitioner seeks early disposal of the appeal filed before the Central Information Commission (CIC).

It is contended by the petitioner that the record i.e. petitioner's answer sheets have not yet been destroyed. It is contended that though the respondent has stated that the same is weeded out. Learned counsel however submits that weeded out does not necessarily imply that the answer-sheets had been destroyed and as per the petitioner the same are still available..

Since there are several cases pending before the CIC which need consideration, it would not be appropriate to direct CIC to take up the petitioner's at an early date unless the CIC is of the view that early disposal is warranted. However, it is directed that if the petitioner's answer-sheets have not been destroyed by the respondents, the respondents shall not destroy the same. The petition is disposed of accordingly.
