% 12.07.2017 C.M. No.22373/2017 (exemption) 1.
Exemption allowed subject to just exceptions. C.M. stands disposed of.
+FAO No.271/2017 and C.M. No.22372/2017 (stay) 2.
This appeal is disposed of as not pressed inasmuch as the appellant challenges the denial of exparte injunction vide impugned order of the trial court dated 1.6.2017 and notice was issued for 3.7.2017, and which date has expired.
3.
Counsel for the appellant expresses an apprehension that FAO No.271/2017
reasoning contained in the impugned order dated 3.7.2017 may influence the decision of the injunction application filed by the appellant/plaintiff, and to which argument this Court need only observe that observations made while denying an exparte injunction are only relevant for the purpose of denying the exparte injunction and whether or not injunction application has to be allowed or disallowed will be an aspect which will be considered independently as per the respective cases of the parties after pleadings are complete and documents of respective parties are also filed. 4.
Appeal is accordingly disposed of with the aforesaid observations.
