BAIL APPLN. 1159/2017 2.This is an application under Section 439 of Code of Criminal Procedure (Cr PC) for grant of regular bail in case FIR No.105/2017 under Sections 323/341/377/452/506/509/34 IPC & Section 6 of POCSO Act registered at PS Maya Puri, New Delhi.
3. This application has been filed after the dismissal of the Petitioner's regular bail application by the learned Additional Sessions Judge (ADJ)-01, District West, Tis Hazari Courts, Delhi on 9th May, 2017.
4. The contention of the Petitioner is that the case against him is different from the case against the main accused as far as offence of sodomizing the
ten-year old boy is concerned. He contends that he has not even been named in the FIR.
5. However, a perusal of the order passed by the learned ASJ reveals that certain facts have emerged during investigation which point to the involvement of the Petitioner around the time of the offence and in the incidents that transpired thereafter.
6. The Court is satisfied that no ground has been made out for grant of regular bail at this stage.
7. The bail application is, accordingly, dismissed. S.MURALIDHAR, J.
