Apprehending his arrest, the petitioner has approached this court for grant him anticipatory bail in case FIR No. 688/2016, registered on 24.09.2016 with Police Station Dabri, Delhi, under Section 448/420/468/471 of IPC.

Status report has been filed.

As per the case of the prosecution, the complainant is the owner of Plot No. 25, N-Block, Chanakya Place Part-II, Uttam Nagar, Delhi-110059. The petitioner had tried to dispossess the complainant several times illegally. The petitioner made several attempts to take forcible possession of the said property from the complainant.

Learned APP submits that during investigation, the documents in favour of the complainant were found genuine and the documents produced by the petitioner were found forged and fabricated. He further submits that
the matter is still under investigation.

Learned counsel for the petitioner submits that he has already filed a civil suit against the complainant, which is pending in the court of learned Senior Civil Judge, Dwarka Courts, Delhi. He further submits that all the original documents had been filed in the civil suit. 6.
It is not disputed by the petitioner that the complainant Deep Chand is in possession of the property in question.

In the facts and circumstances of the case, it is directed that in the event the petitioner is arrested, he shall be released on bail forthwith on his furnishing personal bond in the sum of Rs.30,000/- with two sureties in the like amount to the satisfaction of the MM/Duty MM/IO/SHO/Arresting Officer concerned, subject to the following conditions: - (i) he shall not leave the National Capital Territory of Delhi. (ii) he shall not contact the complainant or his family members in any manner.
(iii) he shall not extend any threat to the complainant or his family members.
(iv) he shall join the investigation as and when called for. (v) he shall not try to dispossess the complainant without due process of law.
