IN THE HIGH COURT OF DELHI AT NEW DELHI
+ BAIL APPLN. 1162/2017 & Crl.M.B.1114/17 GULZAR ..... Petitioner Through :
Mr.Binod K.Agrawal, Advocate.
versus THE STATE ( NCT OF DELHI) ..... Respondent Through :
Mr.Amit Chadha, APP.
SI Pawan Tomar, PS Punjabi Bagh.
CORAM:
HON'BLE MR. JUSTICE S.P.GARG
O R D E R
% 13.02.2018 1.
The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.301/2016 registered under Sections 420/406 IPC at PS Punjabi Bagh. Status report is on record.
2.
I have heard the learned counsel for the parties and have examined the file. By an order dated 15.06.2017, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has joined the investigation since then.
Main allegations are against co-accused Lalit Kumar Sagar who had allegedly obtained a loan of `20 lacs from the complainant bank.
Merely because, the present petitioner purchased the property in question allegedly mortgaged to the bank at a lower price, it is not a sufficient ground to seek his custody. 3.
Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, he be
released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.
4.
The bail application stands disposed of.
