% 10.07.2017 The petitioners had complained of arbitrariness and unfairness with respect to the respondent's action in not taking its bid on record. According to the petitioners, the payment could not be made within the time on account of technical fault in the website of the respondents.

This Court while entertaining this writ petition, issued W.P. (C) 5310/2017

directions to the respondents to technically evaluate the petitioners' bid. The main respondent, i.e., the Central Organisation for Modernisation of Workshops (COFMOW) of the Indian Railways has since complied with the directions. It also stated that further processing of the petitioners' bid and its evaluation would take place and that in these circumstances the present proceedings have been rendered infructuous.

In view of the statement of the Indian Railways/COFMOW that the petitioners' bid would be further processed and evaluated in accordance with the conditions, no further directions are required to be issued.
