CM(M) 1095/2018 & CM APPL. 37355/2018 Vide the present petition, the petitioner assails the impugned order dated 28.08.2018 and 06.09.2018 of the learned Trial Court in Arbitration No. 240/18 submitting inter alia to the effect that an expeditious relief is required in the matter and the matter has not been even heard and that an exparte injunction be granted. Apparently as the matter has not yet been heard by the learned Trial Court, the prayer seeking the setting aside of the impugned order dated 28.08.2018 and 06.09.2018 cannot be granted.

CM(M) 1095/2018

The learned Trial Court is however directed to take up the application filed by the petitioner seeking grant of ex-parte injunction for consideration and adjudication on the date 10.10.2018 without default. The petition is disposed of accordingly.
