+ BAIL APPLN. 1177/2017 SHUBHAM ..... Petitioner Through Mr. Atul K Sharma, Advocate versus STATE ..... Respondent Through Mr. G M Farooqui, APP for State with ASI Hawa Singh, PS Nihal Vihar
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 09.08.2017 Learned counsel for the petitioner submits that petitioner is aged about 19 years. Present FIR is an outcome of landlord-tenant dispute between co-accused Kavita Sharma (landlord) and Rekha Goyal (complainant-tenant). It is stated that the petitioner has been falsely implicated.
It is further submitted that the petitioner has already joined the investigation and nothing is to be recovered from him, therefore, the petitioner be granted anticipatory bail. Learned APP for the State has opposed the bail application of the petitioner and has contended that petitioner is the son of coaccused Kavita Sharma and the complainant has specifically alleged in the FIR that accused persons have taken away the documents with them which are yet to be recovered.
Keeping in mind the totality of facts and circumstances as
detailed hereinabove, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Twenty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
Bail application is disposed of in the above terms. Dasti. A.K. PATHAK, J AUGUST 09, 2017 sm
