CRL.M.C. 3958/2016 This is a petition under Section 482 Cr.P.C filed on behalf of the petitioners seeking quashing of FIR No.276/2011, under Sections 323/308 IPC, registered at Police Station Adarsh Nagar, Delhi. Counsel for the petitioners submits that the petitioners and the complainant are neighbours and due to some misunderstanding a quarrel took place which resulted in registration of the FIR in question. Counsel

further submits that with the help and intervention of the friends and near relatives, the matter has been amicably settled between them to maintain good relationship and neighbourhood in future. He further submits that to upkeep better relations between the petitioner and the respondents No.2 & 3, it has become necessary to quash the proceedings of the present FIR, otherwise the relationship between the petitioners and the respondents No.2 & 3 would not improve, but rather like to deteriorate Further. The respondents No.2 & 3/injured/complainant are present in Court today and have been identified by Investigating Officer, SI Afaque Ahmad. The injured/complainant submit that they have entered into settlement with the petitioners voluntarily and without any force, pressure or coercion and in order to maintain peace and good relations with the petitioners in future. They further submit that they have got no objection if the FIR in question is quashed.

Looking into the facts and circumstances, since the matter is pertaining to the two neighbours, the relationship of the two neighbours is of paramount criteria to maintain peace and harmony between the parties, therefore, keeping in mind to create the stability of peace between the parties and good relationship in near future, I consequently quash the FIR No.276/2011, under Sections 323/308 IPC, registered at Police Station Adarsh Nagar, Delhi and all the proceeding emanating therefrom. The petition stands disposed of accordingly.
