The present petition challenges that order dated 05.10.2016, passed in Case No. CRL/57543/2016 by learned Additional sessions Judge, whereby an order passed by learned Metropolitan Magistrate dismissing the application filed by respondent no. 2 herein under Section 156(3) of the Cr.P.C. was set aside by the learned Additional Sessions Judge, who subsequently directed for registration of FIR against the present petitioner. 2.
Learned APP for the State, on instructions, submits that investigation in the said FIR being FIR No. 1044/2016, under Sections 420/468/471 of the IPC, registered at P.S. Samaypur Badli has been completed and the report has been filed without naming present petitioners as accused(s). 3.
