O R D E R

% 22.03.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 19th August, 2016 passed in W.P.(C) 5447/2016 whereby the Court directed the respondent to decide the Show Cause Notice dated 21st November, 2013.

Today, learned counsel for respondent-EDMC has handed over a photocopy of the reply affidavit dated 21st January, 2017, which is taken on record. In the said reply affidavit, it has been averred as under:- "9.

That the matter has been examined in accordance with applicable rules and procedures and the competent authority has withdrawn the regularization of the existing construction in the property in question vide an order bearing No.EE(B)- 1/Shah(S)/2016D-1692 Dated 07.11.2016. A copy of the order is annexed herewith as Annexure-R-1.

That by another order bearing No.EE(B)- 1/Shah(S)/2016/D-1693 Dated 07.11.2016, the competent authority has also revoked the sanction of building plan for Additions/Alterations in the property in question accorded vide file No.336/1/B/Sh/S/2010 dated 19.04.2010. A copy of the order is annexed herewith as Annexure-R-2.

That the order dated 19.08.2016 passed by this Hon‟ble Court in WP(C) No.5447/2016 has, therefore, been complied with by the respondent Corporation and that there is no defiance of the order/direction of the Hon‟ble High Court of Delhi as alleged."

In view of the aforesaid reply affidavit as well as two orders dated 07th November, 2016, the present contempt petition is disposed of as satisfied.

However, in the event, any of the parties are aggrieved by the aforesaid orders dated 07th November, 2016, they are given liberty to challenge the same in accordance with law. Rights and contentions of all parties are left open.
