% 07.11.2016 Counsel appearing for the respondent Nos.1 and 2 on instructions states that the present writ petition will be treated as representation and a speaking order would be passed.

Keeping in view the facts of the present case, we feel that the statement made by the respondent Nos.1 and 2 should be accepted. The present writ petition would be treated as a representation made by Pradeep Rai, the guarantor. The contention of the petitioner that his pension account cannot be attached will be examined and dealt by the respondent Nos.1 and 2 and a speaking order would be passed.

To cut short the delay, the petitioner is directed to appear before the Assistant Collector, Grade-I on 15th November, 2016. Till 15th November, 2016, the petitioner would be entitled to withdraw from the respondent No.3 bank an amount of Rs.15,000/- as he may require the said amount for his needs and requirements. In case of difficulty, it will be open to the petitioner to move to the respondent No.2 for withdrawal of extra amount. This, we clarify, is an interim arrangement till 15th November, 2016, when respondent No. 2 after considering the submission, would pass an appropriate order. The petitioner, if aggrieved by the said order would be entitled to challenge the same in accordance with law. The writ petition is disposed of.
