Counsel for the appellants after arguments, on instructions, states that the appeal is not pressed but the appellant be given time to vacate the suit premises on or before 30th June, 2017. Appellants will also pay the charges for use and occupation as per the decrees passed by the courts below with arrears being cleared within four weeks from today and, thereafter, to continue to pay every month, month by month, the use and occupation charges till the appellants continuing in possession of the suit premises.

Appellants will also clear all charges towards electricity connection and water connection with respect to the suit premises till the appellants occupy the same. 2.

Let the appellants file affidavit of undertaking in terms of the present order within two weeks from today and on the appellants RSA 324/2016

filing the undertaking and complying with the terms of the same, the appellants will not be evicted from the suit premises till 30.6.2017. 3.

Accordingly, the appeal is disposed of with the aforesaid observations.
