O R D E R

% 16.06.2017 The petitioner impugns the action of the respondents in sealing a portion of the property of the petitioner and the threatened action of demolition.

Learned counsel for the respondents submit that the petitioner had constructed rooms in the stilt portion and respondents have sealed the stilted portion. He submits that in deference to the orders passed by the Appellate Tribunal - MCD no further action of demolition is to be taken against the property of the petitioner till further orders by the Appellate Tribunal - MCD.

In view of the above statement, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to approach the Appellate Tribunal - MCD challenging the action with regard to the sealing of the stilted portion.

The writ petition is accordingly dismissed as withdrawn with liberty as prayed for.
