Department Of Socieal Welfare And ANR v. Central Inforamtion Commission And ANR
$~7 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 10287/2016, CM No. 40530/2016 DEPARTMENT OF SOCIEAL WELFARE AND ANR ..... Petitioners Through:
Mr. Shashank Tiwari and Ms. Sukriti Ghai, Advs.
versus CENTRAL INFORMATION COMMISSION AND ANR ..... Respondents Through:
Respondent no.2 in person.
CORAM:
HON'BLE MR. JUSTICE V. KAMESWAR RAO
O R D E R
% 31.07.2019 The challenge in this writ petition is to the order dated February 11, 2016 passed by the CIC imposing a penalty of Rs.30,000/- on the petitioners. The only submission made by the learned counsel for the petitioners is, the information as sought for by the respondent no.2 was delayed as PIO was on election duty. There is no dispute that one Anjum Masood, DD (Admn.I) was holding the additional charge of PIO when the PIO was on election duty. There is no justification for the person holding the additional charge not to give the information as sought for by the respondent no.2.
In view of the above, the CIC has rightly directed the payment of Rs.30,000/- for the delay in furnishing the information, I do not see any merit in the petition.
The petition is dismissed.
CM. No. 40530/2016 Dismissed as infructuous.
