% 20.08.2018 The parties have entered into settlement in terms of which decree of divorce by mutual consent has also been granted. In terms of the settlement, three criminal cases are sought to be quashed including the one arising out of FIR No. 432/2016 of police station Janak Puri involving offences punishable under Sections 420/468/471/34 of Indian Penal Code, 1860 (IPC). The other cases include one under Section 498A IPC. The grievance of the third and fourth respondents is that the petitioner has not been cooperating in getting the said criminal cases quashed. The petitioner, on being asked, submitted that she has not yet been called upon by the opposite party to sign the petitions for quashing and, therefore, no progress has been made in such regard.

Be that as it may, the present petition has been moved under Section 439 (2) Cr.P.C. seeking cancellation of the bail order granted in favour of third and fourth respondents in case FIR No. 432/2016 of police station Janak Puri.

Given the above developments, there is no good reason why this petition should be kept pending. Even otherwise, there are no sufficient grounds to cancel the bail order. Consequently the request for adjournment is declined.

The petition is dismissed.
