The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.02/2012 registered under Sections 420/467/468/471/34/120B/174A IPC at PS Tilak Nagar. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 08.12.2015. He has been granted bail by this Court in case FIR No.111/2012 registered under Sections 420/467/468/471/34 IPC at PS Tilak Nagar (Annexure 'A-8' page-78). To show his bonafide, the petitioner had deposited a sum of `10 lacs with the bank on 29.08.2016 in the said proceedings.

Initially, the petitioner was arrested in case FIR No.111/2012 registered under Sections 420/467/468/471/34 IPC at PS Tilak Nagar on 12.07.2015. Subsequently, he was formally arrested in the present FIR.

Allegations against the petitioner primarily are that he was witness to various documents furnished with Indian Bank, Tilak Nagar Branch to avail over-draft facility of `90 lacs against security of hypothethication of the stock and collateral security of equitable mortgage property belonging to Jitender Singh situated at WZ-50A, Shyama Prasad Mukharjee Park, New Delhi.

It is alleged that the petitioner was aware that Jitender Singh was not the owner of the said property and it belonged to the complainant with whom at one stage an agreement to sell was executed with him which did not materialise. 5.

Since the petitioner has been granted bail in the main case FIR No.111/2012 registered under Sections 420/467/468/471/34 IPC at PS Tilak Nagar and his custody period is more than one year in this case, he is admitted to bail on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
