O R D E R
% 09.12.2016 Aggrieved by the communication dated 13th October, 2016 declining to grant parole to the petitioner, the petitioner prefers the present petition. The petitioner has sought parole on the ground that he has to file the Special Leave Petition against the judgment of this Court dated 30th May, 2016 in Crl.A. No.803/2015 upholding the conviction and order on sentence passed by the learned Trial Court.
A status report has been filed. As per the status report the father of the petitioner is a Government employee in a bank and resident of D-843, Gali No.15, Gautam Colony Narela, Delhi. As per the nominal roll the appellant has spent nearly one and a half years of incarceration after order of conviction was passed by the learned Trial Court. W.P.(CRL) 3138/2016
Considering the fact that the petitioner has roots in the society and he has been in custody for the last one and a half years, this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court/ CMM/ Duty Magistrate, further subject to the condition that he will not leave the area of NCT Delhi without the prior intimation to the SHO concerned.
