% 21.06.2017 The petitioner is aggrieved by order dated 08.06.2017 whereby the Learned Court had clarified that there is no stay of construction by either of the parties over their respective portion of the suit land. The petitioner claims to be in possession of 100 sq yards and respondent of 100 sq yards of land. The Land measuring 200 sq yards is situated in Khasra No. 120/50 in the Revenue Estate of Village Bakhtawarpur, Delhi.

It is contended that the respondent is raising the construction on 100 sq yards falling to the share of the petitioner. On perusal of the record, it is seen that there is no site plan available on record whereby the respective portions can be identified. Learned counsel for the petitioner seeks leave to withdraw the petition with the liberty to file an application for seeking appropriate CM(M) 660/2017

directions before the Trial Court and annexing therewith a detailed site plan.

The writ petition is dismissed as withdrawn with liberty to the petitioner as prayed for.
