% 25.11.2016 By the present petition, the Petitioner seeks quashing of FIR No. 543/2015 under Sections 379 IPC and Section 135 of the Indian Electricity Act registered at PS Jamia Nagar, Delhi on the complaint of Respondent No.2 on the ground that the petitioner has paid the settled amount and now no due is left towards the respondent No.2.
Ms. Jaya Thakuria, Senior Legal Manager of respondent No.2 is present in Court and is identified by the learned counsel. She states that respondent No.2 has entered into a settlement with the petitioner. Though CRL.M.C. 3987/2016
theft bill was raised for a sum of ₹1,30,785.90 but a settlement has been arrived at for a sum of ₹43,591/- which amount has been deposited by the petitioner. She states that since respondent No.2 has settled the matter with the petitioner, the respondent No.2 does not wish to pursue the above-noted FIR and the proceedings pursuant thereto.
The parties have settled the matter and no useful purpose would be served in continuing the above-noted trial. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No. 543/2015 under Sections 379 IPC and Section 135 of the Indian Electricity Act registered at PS Jamia Nagar, Delhi and proceedings pursuant thereto are hereby quashed. Ms. Jaya Thakuria, authorized representative of respondent No.2 duly identified by the learned counsel has signed this order sheet in acknowledgment of her statements made before this Court. The petition is disposed of. Order dasti.
