On December 3, 2015 learned counsel for the appellant informed that the appellant had expired on July 18, 2015. No application has been filed to bring on record legal heirs of the deceased appellant. Record of the suit is available and we find that respondent No.1, who is the plaintiff, has not filed any application to bring on record the legal heirs of deceased appellant who is defendant No.1 in the plaintiff.

The appeal has obviously abated and therefore dismissed as having abated. The suit has also abated.

No cost.
