% 18.12.2017 Arguments have been addressed on behalf of the either side. On behalf of the applicant it is stated that the applicant has been falsely implicated in the instant case and that there is nothing found in the FIR to indicate that soon before the death of the deceased she was being harassed for dowry or otherwise or treated with cruelty by the applicant, her spouse.
On behalf of the State, the application is vehemently opposed, submitting inter alia to the effect that the charges have been framed against the applicant under Section 304B Indian Penal Code, 1860, and alternatively under Section 302 Indian Penal Code, 1860 inasmuch as the applicant has administered a substance used for killing bugs to his wife resulting into her death on 1.10.2016.
On behalf of the petitioner it has been submitted that the petitioner has
himself got his wife admitted to the hospital. Without making any observations on the merits or demerits of the case and taking into account the averments made in the FIR itself and in the complaint of the father of the deceased to the effect that the aspect of the admission of the deceased in the hospital was informed by the applicant on the next day and not on the date of admission of the deceased to the hospital coupled with the factum the status report on record dated 17.7.2017 submitted by the State indicates that the viscera of the deceased was found to contain pyrethrin and kerosin coupled with the submission made on behalf of the State to the effect that the same had been administered to the deceased by the applicant, there is no ground to grant bail to the applicant. The application is, therefore, dismissed.
