O R D E R
% 16.02.2017 Learned counsel for the petitioner submits that general allegations of harassment have been levelled in the FIR against the petitioner. It is further submitted that the marriage was solemnized on 21st October, 2014. Complainant left the matrimonial home on 5th March, 2015. However, FIR has been lodged on 8th August, 2016. Prior thereto the matter was settled vide Agreement (Annexure P-2 at page 43). Complainant had taken all the dowry articles belonging to her.
Complainant as well as her brother had signed the agreement.
Learned APP, who is assisted by the counsel for complainant, has opposed the grant of anticipatory bail. It is submitted that
dowry articles have not been returned. When complainant and her brother had gone to the house of petitioner they were forced to sign the blank documents, which have been converted into the alleged agreement. Complainant, in the FIR, has also alleged about the unnatural sex done by the petitioner during her stay with him.
Learned APP further submits that investigations are complete, wherein petitioner had participated.
Keeping in mind the totality of circumstances, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
Bail application is disposed of in the above terms. Dasti.
