O R D E R

% 23.06.2017 Present writ petition has been filed challenging the interim order dated 30th May, 2017 passed by the Central Administrative Tribunal (CAT), whereby one post of staff nurse has been directed to be kept vacant during the pendency of OA filed by the petitioner. Appointment of other successful candidates were permitted to be made but subject to final outcome of OA.

Learned counsel for the petitioner states that on 25th May, 2017, the Government has uploaded Notification vide which only one question has been declared invalid and that too for Shift-I. She, however, states that benefit has been given to Shift-II examinees also.

She further states that upon a subsequent application being filed before the CAT, only notice has been issued on 16th June, 2017 returnable for 10th July, 2017.

In the opinion of this Court, the interest of the petitioner has been adequately safeguarded as one post has been kept vacant and even other appointments have been made subject to further orders to be passed by the CAT. Moreover, the order dated 16th June, 2017 has not been challenged before this Court. In any event, as the impugned order is only an interim order, no interference is called for at this stage.

Accordingly, the present writ petition being bereft of merits is dismissed.
