% 12.07.2017 The petitioner seeks bail in anticipation of his arrest in connection with FIR No.197/2017 dated 29.04.2017 (PS Sangam Vihar) instituted for the offences under sections 452/323/509/354/34 of the IPC read with section 12 of the POCSO Act.

The allegation against the petitioner and others is of assaulting the persons of the prosecution side and one of the sons of the petitioner is also alleged to have committed an act leading to his prosecution under section 12 of the POCSO Act. It has been submitted on behalf of the petitioner that he is a government servant and was hospitalized from 24.05.2017 to 27.05.2017. The date of occurrence is stated to be 28.04.2017. The quarrel took place between the parties because one of the sons of the petitioner used the bicycle of the son of the complainant. The complainant thereafter scolded the son of the petitioner.

This led to scuffle between the two families wherein the petitioner along with others are said to have assaulted

some of the persons. One of the sons of the petitioner is said to have misbehaved with the daughter of the complainant. Be that as it may, taking into account the fact that the petitioner has been participating in the investigation and also the nature of accusation, this Court is inclined to grant anticipatory bail to the petitioner. In the event of arrest or surrender, the petitioner shall be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the arresting officer. Needless to state that like in the past, the petitioner ought to participate in the investigation and visit the IO as and when required by him. The application is disposed of.
