O R D E R
% 05.09.2018 Complainant M/s. Heeraji Biofuel Industries is being represented through the Manager Mr. Moti Lal Saini, who has placed on record Authorization Letter in his favour, executed by M/s. Heeraji Biofuel Industries. During the course of hearing, disputes involved in the FIR have been settled between the parties. Petitioner has offered to pay ₹9,00,000/- towards full and final settlement of all its claim involved in the FIR No. 80/2017 under Sections 420/406/34 IPC at police station Amar Colony. Mr. Moti Lal Saini submits that he has got instructions from the complainant to
convey to Court that this amount is acceptable to the complainant. ₹4,50,000/- has already been received by the complainant on the last date of hearing, that is, 7th August, 2018. Counsel for the petitioner submits that balance amount of ₹4,50,000/- would be paid at the time of quashing of FIR. It is submitted that petition for quashing of the FIR would be filed within two weeks.
The remaining settled amount shall be paid by the petitioner to the complainant at the time of quashing of FIR through a demand draft.
Keeping in mind the settlement arrived at between the petitioner and complainant, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of ₹20,000/-(Rupees Twenty Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Bail application is disposed of in the above terms. Dasti.
