By the present petition filed under Article 227 of the Constitution of India, the petitioner seeks to impugn the order dated 03.05.2016 by which a review petition to review order dated 19.11.2015 was dismissed. 2.

The learned counsel for the petitioner submits that against the order dated 19.11.2015 an appeal has been filed, which is pending before this court. He submits that before this court in FAO No.352/2016 he has confined his appeal only to challenge against the order dated 19.11.2015. 3.

It was put to the learned counsel for the petitioner that as the main order dated 19.11.2015 is already under challenge before this court, then the present petition seeking to challenge the dismissal of the review petition by order dated 03.05.2016 would not be appropriate. 4.

Accordingly, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to press his appeal being FAO No.352/2016

before the concerned court.

Granting leave and liberty as above, the present petition is dismissed as withdrawn. All the pending applications are also dismissed. JAYANT NATH, J.
