This Court is of the view that the appellant has an alternate effective remedy by filing an application under Order 39 Rule 4 CPC. Consequently, present appeal and applications are disposed of with liberty to appellant to file an application under Order 39 Rule 4 CPC. The rights and contentions of all parties are left open.
