% 02.11.2016 Petitioner is aggrieved by the inaction on the part of the respondent. His submission is that his application which is lying pending since 15.9.2015 before the SDM for recalling of order dated 13.3.1990 has not been up for hearing. The submission in the aforenoted application is that he learnt about the order dated 13.3.1990 only on 03.8.2015. This was an ex parte order. On advance notice, learned counsel for respondent has put in appearance. He has no instruction in the matter. The application pending before the SDM shall be decided expeditiously by the respondent.

Petition disposed of.
