This petition by way of public interest litigation has been filed alleging that the respondents had failed to comply with the provisions of DG(S&D) Manual, CVC Circulars and Guidelines in public procurement through Government e-Market place (GeM).

Heard the learned counsel for both the parties. 3.

The material available on record shows that the petitioner made a detailed representation on 15.10.2016 bringing the alleged irregularities to the notice of the respondents herein. Though by the date of filing of the writ petition on 25.10.2016, there was no response from the respondents, it is W.P.(C) No.10319/2016 Page 1 of 2.

now brought to our notice by Sh.Sanjay Jain, the learned ASG appearing for the respondents that a detailed reply dated 28.10.2016 was sent to the petitioner explaining all the issues raised by the petitioner. The said fact has not been disputed by the learned counsel for the petitioner. 4.

In the light of the letter of the respondent No.2 dated 28.10.2016, we are of the view that the cause of action in the writ petition does not survive. Accordingly, we consider it appropriate to dispose of the writ petition granting leave and liberty to the petitioner to file a fresh petition for redressal of further grievance, if any.
