% 26.09.2017 The suit has been listed on office note. As per the office note the present suit seeking recovery for a sum of ₹49,20,300/- with interest thereon, was filed on 30th May, 2015. On 25th June 2015 the Registry raised certain objections, however, till date the objections have not been removed. In terms of Rule-5(1) and 5 (2), Part-A (a), Chapter-I, Volume-5 of Delhi High Court Rules, objections are required to be removed within 30 days failing which the suit has to be listed before Court for dismissal for non-prosecution.

At this stage, learned counsel for the plaintiff seeks return of the plaint. Objections in the plaint having not been removed, this Court will not pass any order which would have the effect on the limitation. Therefore, the suit is dismissed for non-prosecution. MUKTA GUPTA, J.
