O R D E R

% 10.07.2017 Petitioner has been produced from jail. Petitioner submits that he had earlier appointed Mr. Javed Iqbal Wani, Advocate as his counsel who is a resident of Srinagar, but later gave his vakalatnama in favour of Mr. Mukesh Anand, Advocate.

It is 3:00 p.m., matter has been called thrice since morning. On 07.07.2017, Ms. Mehak Gupta, Proxy Counsel for Mr. Javed Iqbal Wani, Advocate appeared, but none has appeared on his behalf today. In these circumstances, Mr. Javed Iqbal Wani, Advocate is discharged. Learned counsel for the parties submits that both the parties have resolved their dispute amicably for a sum of Rs.51,00,000/- to be paid by the petitioner to the complainant. Complainant submits that he has received the entire settled amount.

Statements of the parties have been recorded separately. Learned counsel for the complainant submits that the complainant has received the settlement amount and he does not wish to proceed further with the complaint lodged by him.

Considering the nature of allegations and the fact that the parties have arrived at a settlement, this Court deems it fit to grant bail to the petitioner. It is, therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of Rs50,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court and the surety shall furnish a F.D.R. of Rs.50,000/- with the concerned Trial Court, further subject to the condition that he will not leave the country without the prior permission of the Court concerned.

Petition is disposed of.
