% 05.03.2018 CM. APPL. 9140/2017 (recalling of order dated 23.12.2016) 1.
This is an application seeking recall of order dated 23.12.2016 passed by this Court. By virtue of order dated 23.12.2016, this Court had disposed of the writ petition by directing the petitioner to move an appropriate application under Section 70 of Wakf Act, 1995. 2.
Counsel for the petitioner says that, accordingly, an application was filed in and about 30.12.2016. Learned counsel for the petitioner further submits that despite the fact that more than one year has lapsed, the said application has not been disposed of.
3.
Mr. Wajeeh Shafiq , who appears for respondent no. 1, says that the powers of the Delhi Wakf Board are, presently, being exercised by the Divisional Commissioner, and that, if a suitable direction is issued by the
Court, petitioner‟s grievance shall stand addressed. 4.
Accordingly, the captioned application is disposed of with a direction to the concerned Divisional Commissioner to dispose of the petitioner‟s application preferred under Section 70 of the Wakf Act, 1995 within four weeks from the date of receipt of a copy of the order.
