% 03.11.2016 Petitioner seeks parole on the ground that his surgery is to be performed in All India Institute of Medical Sciences (AIIMS). On the same ground W.P. (Crl.) 2241/2016 was filed which was disposed of vide order dated 6th September, 2016.
In the said order, it has been noted that no surgery was required as per the report received from the AIIMS. However, it was observed that in case it is opined that petitioner requires surgery, it shall be open to the petitioner to approach this Court seeking parole. Latest medical status report of the petitioner has been obtained from the Superintendent Jail wherein it has been categorically mentioned that petitioner was taken to AIIMS on 1st and 18th October, 2016 but no surgery
was advised nor any date for surgery was fixed. In view of above, writ petition is dismissed. A.K. PATHAK, J.
