BAIL APPLN. 2230/2016 Issue notice. Ms. Kolluru accepts notice on behalf of the State. Notice is accepted on behalf of respondent No.2 by her father, who is present in Court. Respondent No.2 is also represented through her counsel. The submission of learned counsel for the petitioner is that the petitioner has already joined the investigation. He submits that in respect of several items claimed by the complainant/ respondent No.2, the petitioner
has already sent a reply and admitted to the fact that several of those items have been left by the complainant in her matrimonial home, which the petitioner is ready & willing to return. In this regard, reference is made to the response given by the petitioner to the SHO/ I.O. on 17.09.2016. The father of the complainant, who is present in Court, states that the said list of items, which the petitioner is ready & willing to return, is only a fraction of the items given in dowry at the time of marriage of the complainant with the petitioner.
Be that as it may, without prejudice to the rights & contentions and claims of either of the parties, let the items that the petitioner is ready & willing to return, be returned to the complainant in the presence of the I.O. A detailed list of the items being returned be prepared and photographs shall also be taken. The list of items which are returned shall be mutually signed by the parties in acknowledgement of handing over and taking over of the same. The said exercise be carried out today itself at 04:00 p.m. at the PS - Dwarka (North).
Subject to the petitioner joining the investigation, I direct that in case of his arrest, he shall be released on bail upon his furnishing personal bond with one surety in the sum of Rs.20,000/- to the satisfaction of the arresting officer.
The petition stands disposed of in the aforesaid terms. Dasti.
